Car Check Terms & Conditions
General
In these terms and conditions the following expressions shall have the following meanings:-
"we"/ "us"/ "ours"
means or refers to CarsIreland.ie and it's partners in the supply of used vehicle information (specifically Cartell)(“Cartell” is a registered business name ), who provides the Information to you;
"you"/ "your"
means or refers to you, the customer, who submits the Enquiry and receives the Information (in each case subject to these Conditions);
"Enquiry"
means a CarsIreland.ie / Cartell enquiry submitted by you either online at the Website, by telephone to the CarsIreland.ie / Cartell Offices or by SMS to our SMS Services;
"Information"
means the information supplied by us relating to a motor vehicle or related information recorded on our electronic database in response to your Enquiry;
"Contract"
means the contract between you and us for the supply of the Information made subject to these Conditions;
"Website"
means the CarsIreland.ie website;
“Private Portal”
Means the new portal a potential buyer or a private seller can use to access their new CarsIreland account. This allows them to manage their ads across desktop and mobile web (note that this capability is not currently supported on the CarsIreland mobile app);
“User authentication”
Means the process of confirming the identity of a user where they are engaging with the new private portal. This involves verifying the user’s identity via Amazon Cognito.
"Email Comms"
Means the ways in which we will engage or re-engage with you as either a prospective buyer or private seller engaging with us as an account holder with Cars Ireland.
When you submit an Enquiry to us, this constitutes an offer by you to enter into a Contract with us for the provision of Information subject to these Terms & Conditions. A Contract will only come into existence between you and us when we provide to you Information in response to your Enquiry whether by email, online via the website, downloaded from the website or via SMS. We reserve the right for any reason and without explanation to decline to enter into a Contract with you.
The Contract and all Information provided shall be subject to these Terms & Conditions which apply to the exclusion of all other terms, conditions and statements.
When submitting your Enquiry at our Website, it is your responsibility to complete the request screens at our Website fully and correctly to ensure a prompt response by us. When submitting your Enquiry over the telephone or via SMS, you must provide us with accurate and complete information to ensure we are able to deal with your Enquiry promptly. It is also your responsibility when using CarsIreland.ie's / Cartell services to notify us if we supply any Information which you know or suspect is incorrect or incomplete.
Website Conditions of Use
Use of the CarsIreland.ie website and related services delivered outside the website such as SMS services is subject to a number of terms & conditions as set out below. If you have any questions on these terms and conditions please do not hesitate to contact us.
Each time you access the website you will be deemed to have read and accepted these Terms & Conditions and you accept that you will be bound by them. CarsIreland.ie / Cartell reserves the right to alter the Terms & Conditions at any time and you are obliged to check if changes have been made to the Terms & Conditions. Your use of this web site after changes have been made to the online Terms & Conditions shall constitute acceptance of the revised Terms & Conditions.
If you do not agree to abide by any of these Terms & Conditions you should cease using the CarsIreland.ie website and any related services such as SMS services immediately.

Charges
You will pay us our charges for the Information and Services provided at our current levels from time to time, by credit card or any other payment method we accept (details of which are available at the Website), before we send you the Information.
Limitation of Liability
CarsIreland.ie / Cartell shall not be liable for any damages whatsoever, and in particular CarsIreland.ie shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, business interruption, loss of revenue, or loss of use, arising out of or related to this Site, the Content or the Materials, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if CarsIreland.ie has been advised of the possibility of such damages.
CarsIreland.ie / Cartell cannot, at any time, accept responsibility for any losses, injuries, inconvenience or expenses caused due to Force Majeure including but not limited to government action or restraint, war, riot, civil strife, industrial dispute, strikes, terrorist activity, natural or nuclear disaster, fire, flood, delays, weather conditions or the threat of any of these or any other event beyond its control.
Indemnification
You agree to indemnify and hold CarsIreland.ie / Cartell, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable legal fees and costs, made by any third party due to or arising out of your use of the Site the Content or the Materials, the violation of these Terms, or the infringement by you, or any other user of the Site using the your computer of any intellectual property rights of any third party.
Use of your Personal Data
We obtain and hold vehicle and associated data from many sources, including finance companies, insurers, vehicle owners. This data is used to protect both those making searches and the owners of vehicles on the Cartell database. For that reason, you agree and consent to us disclosing relevant information about you (including your name, address and details of your usage of CarsIreland.ie's services) to any person to whom we consider that it would be expedient to do so, for the sole purposes of preventing, detecting or discouraging crime, for the apprehension or prosecution of offenders, or for the recovery of stolen vehicles or other property. Without limiting the foregoing, you expressly agree and consent to us disclosing any such information about you to:-
- a person claiming to be owner of a vehicle against which you have submitted an Enquiry; or
- the police or other law enforcement authorities.
Your use of the Information
The Information we provide to you is for your own personal use. Accordingly you must not sell, supply or otherwise disclose the Information to any third party, but you may supply free of charge a printed copy of the Information to any potential purchaser or the seller of a vehicle to which the Information relates (in the course of negotiating the purchase or sale of the vehicle) provided that the Information is in the form supplied by us (without amendment to any of the contents).
Governing Law
The information contained on, and your use of, this website and these Terms & Conditions shall be governed by the laws of the Republic Of Ireland, and you agree to submit to the exclusive jurisdiction of the Irish Courts in relation to any matter arising under or in connection with your use of this website or its contents.
CarsIreland hereby confirms that, as per the Digital Services Act (Article 24(2)) obligations, it has an average of monthly active recipients less than 45 million. The average was calculated based upon the last six months (previous calculation done on 17th February 2024). Please note that this calculation has been specifically prepared to fulfill our requirements under the DSA and should not be used for any other purposes.

New Private Portal
Overview
This new service will allow for the creation of a new CarsIreland account which can be used by a prospective buyer or private seller in the following ways:
- Buyer: Ability to log in to their account via desktop or mobile web and manage their saved ads via their new account with CarsIreland (my.carsireland.ie)
- Private seller: Ability to log into their account to manage one or multiple ad postings and also track any saved ads they may have where they are acting as both buyer and private seller.
User Authentication
To safeguard your details you will be required to complete a user authentication process which will work as follows:
- If you choose to register via email you will be required to activate your account via the link we will supply to via email (sent to the email address supplied as part of your registration form).
- If you choose the social log in option you can use either Google or Facebook to gain access to the new portal.
Log In Capability
Prospective Buyer
If you engage with the heart icon on either an ad page or via our results page after the launch of this service you will be presented with a native log in form.
- If you have previously registered via email you can use the email and password you set previously to gain access to your account.
- If you have not registered previously via email you can select either of the social log in options (Google or Facebook) or select the ‘Register’ link to access the registration form.
Private Seller
If you engage with the Login/Register link on the site navigation or select the ‘Place Ad’ call to action link you will be prompted to either register or sign into the new private portal:
- If you had an account on the old private portal you will have received an email from us letting you know we have set up a new account for you that you need to confirm to retain access to your ad for editing purposes and also gain access to the new and improved private portal.
- Please note that if you had an account with us previously and you have not yet confirmed your account the link we shared will know have expired. If that is the case please reach out to our Customer Support team via the contact form here so we can work with you to get your access issues sorted.
- If you have previously registered via email you can use the email and password you set previously to gain access to your account.
- If you have not registered previously via email you can select either of the social log in options (Google or Facebook) or select the ‘Register link to access the registration form.
- Please note this new portal will replace what is currently in use for private sellers within the CarsIreland ecosystem with the added benefit of a better quality user experience as well as the ability to post multiple ads all managed with a single log in (as opposed to the current system where the user is given a password with which they can edit a single ad they have placed with us).
Ad Creation Experience
Overview
As we continue to refine our product offerings the choice available on our plan page for those creating an ad will include options for online only ads or those that also include a newspaper option. By default online ads will stay live for a period of 1 year or until your ad is sold - after the 1 year mark we will check in with you to see if you still need your ad and if so your ad will be renewed free of charge for the same period again. This practice is to ensure you have your ad live for as long as it takes to sell your car and also provides a housekeeping discipline for us to make sure the content on our site remains relevant for perspective buyers.
How the bundles work
If you choose an online only ad package (this is called the ‘Standard’ bundle) then your ad will be visible on the CarsIreland site only. However, if you choose one of the other available bundles (currently called ‘Premium’, ‘Premium Plus’ or ‘Platinum’) both an an online ad and ad in the newspaper(s) will be placed. The location of your ad and quantity of ad spots you have chosen to secure as part of the ad creation flow will be clearly communicated to you when placing your ad and again within your confirmation mail.
For example if you are creating an ad and select the ‘Premium’ option this will allow you to purchase an ad on CarsIreland.ie and also secures you 5 ad spots within The Herald with fully completed ads associated with a newspaper bundle (currently Premium, Premium Plus and Platinum) being allocated the next available slots in the paper or papers relevant for the bundle selected.
Please note if you have selected a bundle that includes a newspaper option your ad will only be queued for inclusion in the relevant newspaper(s) once all required details including your VIN have been supplied and your ad has been paid for. Where you have chosen your bundle, paid for your ad but later come back to confirm you are the owner of the car by supplying your VIN then you will receive a further email from us indicating the dates your ad is due to be published in the relevant newspaper(s) based on the next available slots after your ad has been added to the queue for processing. With any newspaper package this will be two days before the next available slot for the day(s) relevant for the bundle selected.
Email Comms
By accepting these terms you agree to our engagement/re-engagement with you via email in the following scenarios:
- Standard engagement/re-engagement practices for a private seller – where we see you have created a partial ad we will re-engage with you to see if you require assistance to complete your ad e.g. we will engage with you where all elements of your ad has been completed but payment is pending or your ad is currently on hold pending verification of your log book (required for you to place an ad within the new portal)
- Wider service offering – where you have created an account with us with the intention of acting as a buyer or private seller or both we will engage with you where we are expanding the service offering you have created an account to access e.g. where new capabilities have become available that may be of interest to you as a private seller or where enhanced search/filter capabilities become available that could enhance your experience as a prospective buyer
Use of your personal data
- Your data will solely be used for the purposes of enhancing your search experience with us as a prospective buyer or the sales experience with us as a private seller follow your decision to register for an account with Cars Ireland
- If you have partially created an ad with us the data relating to this data will be removed where your ad remains in draft mode for longer than 6 months
- Should you wish for your data on file with us to be removed at any stage you can submit a deletion request via data[email protected] and we will ensure your ad and personal details are removed from our system
